2. Definitions

- Client: The individual or entity engaging our services.
- Services: The garden clearance and related services provided by Garden Clearance Elephant and Castle.
3. Service Agreement
Garden Clearance Elephant and Castle agrees to provide garden clearance services as per the specifications agreed upon with the Client. The scope of work will be outlined in a separate Service Agreement document.
3.1 Scope of Services
The services include, but are not limited to:
- Removal of garden waste and debris.
- Pruning and trimming of plants and shrubs.
- Clearing of pathways and lawns.
- Disposal of removed materials in an environmentally responsible manner.
3.2 Changes to Services
Any changes to the scope of services must be agreed upon in writing by both parties. Additional charges may apply for services outside the original agreement.
4. Pricing and Payment
All prices for services are provided as estimates and are subject to change based on the actual work required. The Client will receive a detailed invoice upon completion of services.
4.1 Payment Terms
Payment is due within 14 days of the invoice date, unless otherwise agreed upon. Accepted payment methods include bank transfer, credit card, and cash.
4.2 Late Payments
Late payments may incur additional charges as outlined in the invoice. Persistent late payments may result in suspension of services.
5. Scheduling and Cancellation
Services will be scheduled based on availability and confirmed with the Client. Cancellations must be made at least 48 hours in advance to avoid cancellation fees.
5.1 Rescheduling
Clients may reschedule services by contacting our office. We strive to accommodate all reasonable requests but cannot guarantee availability.
5.2 Cancellation Fees
Failure to provide sufficient notice for cancellations may result in a cancellation fee equivalent to the cost of preparing for the scheduled services.
6. Liability
Garden Clearance Elephant and Castle is committed to providing high-quality services. However, we cannot be held liable for any damages resulting from pre-existing conditions, natural disasters, or factors beyond our control.
6.1 Limitation of Liability
Our liability is limited to the total amount paid for the services. We are not liable for indirect, incidental, or consequential damages arising from the use of our services.
7. Insurance
We maintain appropriate insurance coverage to protect both our company and our clients. Clients are not required to provide additional insurance unless specified in the Service Agreement.
7.1 Damage to Property
In the event of accidental damage to property during service delivery, we will take immediate steps to rectify the situation. Any claims should be reported within 7 days of the incident.
8. Privacy Policy
Your privacy is important to us. Any personal information collected will be used solely for the purpose of providing our services and will not be shared with third parties without your consent, except as required by law.
8.1 Data Protection
We comply with all relevant data protection regulations to ensure the security and confidentiality of your personal information.
9. Changes to Terms and Conditions
We reserve the right to modify these Terms and Conditions at any time. Any changes will be communicated to clients via email or through our website. Continued use of our services constitutes acceptance of the updated terms.
9.1 Notification of Changes
Significant changes to our terms will be highlighted and clients will be notified within 30 days of implementation.
10. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the jurisdiction in which Garden Clearance Elephant and Castle operates. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts in that jurisdiction.
11. Severability
If any provision of these Terms and Conditions is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
12. Entire Agreement
These Terms and Conditions constitute the entire agreement between Garden Clearance Elephant and Castle and the Client regarding the use of our services, superseding any prior agreements or understandings.
12.1 No Waiver
Failure by Garden Clearance Elephant and Castle to enforce any right or provision of these Terms and Conditions will not be deemed a waiver of such rights.
By engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
